Part One — Guest Guide
Last updated: 2026. Rockin N Rollin LLC, doing business as RnRBus.
This guide explains our most important rules and charges in plain English. It is a summary only. The Charter Services Agreement in Part Two is the binding contract, and it controls if anything here is different.
Booking and payment
Deposit: $325, non-refundable. We charge it only after we confirm your date, time, and bus are available.
Balance: Due at or before pickup. Pay online in advance or pay your driver. If it is unpaid at pickup, we charge the card on file.
Gratuity: Standard gratuity is included in your price. Extra tips are optional.
Payment fees: No fee on the deposit or on cash. A 3% surcharge applies to credit cards (never debit cards). A 3% fee applies to Venmo. Checks are accepted only for weddings and approved business accounts.
Card on file: Your card may be charged for your balance, added time, cancellation charges, cleaning, bio-hazard, damage, tolls, and parking.
Cancellations and changes
Cancel by email to info@rnrbus.com. Your deposit is non-refundable.
Less than 30 days before your date: you owe 50% of the total (your deposit counts toward it).
Less than 14 days before your date: you owe 100% of the total.
Time you add cannot be removed later. Switching buses needs 30 days' notice.
Your time starts at the scheduled pickup time, even if your group is late. There are no refunds for unused time.
Weather and mechanical problems
Your driver can delay, reroute, or end a trip if roads are unsafe. If a breakdown or bad weather affects your trip, we handle it case by case: a replacement bus, a new date, a credit, or a refund. If we cancel before your trip starts and can't fix it, you get your money back.
Who can ride
The person booking must be 21 or older.
Guests under 21 are welcome on holiday light tours and daytime weddings. For any other trip, get our approval before you book.
The person booking is responsible for every guest, including underage guests, and must let each minor's parent or guardian know about the trip and the rules.
Guests under 19 need a parent or guardian chaperone on board.
Bring a valid, original photo ID. Drivers check IDs by sight and never copy or photograph them.
Alcohol
We do not sell or serve alcohol. Guests 21 and older may bring their own.
Not allowed: glass beer bottles, jello shots, red wine, kegs, beer bongs, and containers of 5 gallons or more.
No one under 21 may have alcohol. If an underage guest is caught with alcohol, the trip ends for everyone with no refund.
Rules on the bus
Stay seated or hold a handrail while the bus is moving.
Nothing and no one out of the windows or hatches.
No smoking or vaping of any kind, no drugs, no weapons, and no fireworks.
No confetti, glitter, or silly string.
Follow the driver's instructions at all times. The driver can end the trip for unsafe or illegal behavior, with no refund.
If a guest gets too intoxicated, your group uses its time to take them back to the pickup spot or arranges a safe ride home. We will call 911 if someone needs help.
Charges you can avoid
Bio-hazard (vomit, urine, or other bodily fluids): $200 per incident.
Excessive mess: $75.
Damage or theft: replacement cost, plus $150 per hour of labor and lost revenue while the bus is out of service.
We send photos and an itemized statement before charging for damage.
Cameras, photos, calls, and texts
Our buses have cameras that record video, and audio where equipped.
We may use photos and video from trips in our marketing. To opt out, tell your driver or email info@rnrbus.com.
Calls with our office may be recorded.
We text about your reservation. Reply STOP to opt out. We never share your mobile number for others' marketing.
Your safety and our liability
Party bus rides carry real risks, including sudden stops, standing or dancing while moving, and the behavior of other guests. By booking, you accept those risks for yourself and, as far as the law allows, for the adults in your group. You also release RnRBus, its owner, employees, and drivers from claims, including claims for ordinary negligence, and you are responsible for your guests' conduct. Most disputes go to individual arbitration instead of court, and you give up jury trials and class actions. Read Articles 23 through 29 in Part Two carefully before you book.

Part Two — Charter Services Agreement
Effective date: 09/2026
This Charter Services Agreement (this "Agreement") is entered into between Rockin N Rollin LLC, an Iowa limited liability company registered to transact business in Nebraska and doing business as RnRBus ("Company"), and the Customer identified in the Reservation. In consideration of the transportation services, the mutual promises in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the parties agree as follows.
NOTICE: ARTICLES 23 THROUGH 29 CONTAIN AN ASSUMPTION OF RISK, A RELEASE OF LIABILITY INCLUDING FOR COMPANY'S NEGLIGENCE, AN INDEMNITY, A LIMITATION OF LIABILITY, AND AN AGREEMENT TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS WITH A WAIVER OF CLASS ACTIONS AND JURY TRIALS. READ THEM CAREFULLY.
Article 1 — Definitions and Interpretation
1.1 Definitions. In this Agreement:
"Additional Time" means time added to a Charter under Section 8.2.
"Chaperone" means an adult, age 21 or older, who rides for the entire Charter to supervise Minors under Article 11 and who is either a Parent of a Minor aboard or an adult authorized by the Parents of the Minors aboard to supervise them.
"Charter" means the transportation service described in the Reservation, including its date, scheduled times, Vehicle, and any Additional Time or added services.
"Charter Price" means the total price for the Charter shown in the Confirmation, including standard gratuity, plus any Additional Time or added services, excluding fees and charges under Articles 5, 6, 7, and 17.
"Claims" means all claims, demands, suits, actions, causes of action, liabilities, losses, damages, judgments, settlements, fines, penalties, costs, and expenses of any kind, including reasonable attorneys' fees and costs, whether known or unknown and whether in contract, tort, statute, or otherwise.
"Company Parties" or "Released Parties" means Company; its members, managers, owners, officers, employees, drivers and chauffeurs, independent contractors, agents, and volunteers; its affiliates, including any affiliated company operating under common ownership; any carrier providing a substitute vehicle under Article 9; and the successors and assigns of each.
"Confirmation" means Company's written confirmation of the Charter sent after the Deposit is charged.
"Customer" means the individual who submits or signs the Reservation and, if the Reservation is made for a business or organization, that entity as well, jointly and severally.
"Deposit" means the non-refundable $325 deposit described in Article 4.
"Guest" means every person who rides in, boards, attempts to board, or is transported in a Vehicle during the Charter, including Customer.
"Minor" means a Guest under 19 years of age, the age of majority in Nebraska.
"Parent" means a Minor's parent or legal guardian.
"Published Rates" means Company's rates, packages, and additional-time rates as published on Company's website or rate schedule when the Reservation is confirmed.
"Recordings" means video, audio, still images, and data recorded by cameras or other devices in or on a Vehicle, and recordings of telephone calls with Company.
"Reservation" means Customer's request for a Charter, whether made online, by phone, by email, or in writing.
"Rider Rules" means Articles 10 through 16 and any rules posted in a Vehicle or given by a driver.
"Underage Guest" means a Guest under 21 years of age.
"Vehicle" means any bus, limousine, or other vehicle used for the Charter, including a substitute vehicle.
1.2 Interpretation. Headings are for convenience only. "Including" means "including without limitation." The singular includes the plural. "Days" means calendar days. "In writing" and "written" include email, text message, and entries in the Confirmation or Company's booking system. References to law include statutes, regulations, ordinances, and orders as amended. The phrase "to the fullest extent permitted by law" applies to every limitation, release, waiver, and indemnity in this Agreement whether or not stated. This Agreement will be interpreted as a whole according to its plain meaning, and no provision will be construed against either party as its drafter.
Article 2 — Formation, Acceptance, and Order of Precedence
2.1 Acceptance. Customer accepts this Agreement by the earliest of: checking the acceptance box and submitting a Reservation; signing or electronically signing a Reservation, Confirmation, or this Agreement; paying any amount to Company; or boarding a Vehicle. Customer agrees that checking a box, typing a name, or clicking to submit is Customer's legally binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act and the Uniform Electronic Transactions Act as adopted in Iowa and Nebraska.
2.2 Capacity and Authority. Customer represents and warrants that Customer is at least 21 years of age and legally competent to contract. If Customer books for a business or organization, the individual signing represents that he or she is authorized to bind it, and the individual and the organization are jointly and severally liable under this Agreement.
2.3 Customer's Responsibility for Guests. Customer is responsible for every Guest. Customer will provide the Rider Rules to all Guests before the Charter, will comply with Article 11 for every Underage Guest, and is liable for all acts and omissions of Guests as if they were Customer's own.
2.4 Documents and Precedence. This Agreement incorporates the Confirmation, the Published Rates, the Privacy Policy, and any rules posted in a Vehicle. If documents conflict, the following order controls: (a) a written amendment signed by an authorized manager of Company; (b) the Confirmation, but only as to date, times, Vehicle, pickup and drop-off locations, and price; (c) this Part Two; (d) the Privacy Policy; (e) Part One, the Guest Guide, which is a summary only and creates no rights; and (f) any other website content, advertising, or statement.
2.5 No Oral Modifications. No driver, dispatcher, or employee other than an authorized manager of Company may waive, change, or add to this Agreement, and any waiver or change must be in writing. Accommodations a driver makes during a Charter are courtesies, not waivers.
2.6 Guests Who Board. Every Guest who boards a Vehicle does so subject to the Rider Rules, Article 20, and Company's right to refuse or end service, and agrees to them by boarding. Customer represents that each adult Guest in Customer's party has authorized Customer to arrange the Charter on that Guest's behalf. To the fullest extent permitted by law, Customer accepts this Agreement, including Articles 23 and 24, on behalf of each adult Guest in Customer's party, and accepts the Rider Rules and Article 20 on behalf of every Guest. Customer will indemnify the Company Parties against any Claim arising from Customer's failure to inform a Guest of this Agreement or from any Guest's assertion that Customer lacked that authority.
Article 3 — Company Status, Operating Authority, and Refusal of Service
3.1 Operating Authority. Company operates under authority issued by the Nebraska Public Service Commission and the U.S. Department of Transportation and holds a license from the Nebraska Liquor Control Commission. Company provides service in the Omaha–Council Bluffs metropolitan area and elsewhere in Nebraska and Iowa as its authority allows. Travel outside the Omaha–Council Bluffs metropolitan area must be approved in advance in writing and may carry additional charges.
3.2 Transportation Only. Company provides transportation only. Company does not own, operate, control, or endorse any venue, bar, restaurant, event, or destination, and is not responsible for their conditions, policies, admission, or conduct. Company does not sell, serve, or furnish alcohol.
3.3 Right to Refuse Service. Company may decline any Reservation and may refuse to transport any person for any reason not prohibited by law, including safety, intoxication, conduct, failure to produce identification, or violation of this Agreement.
3.4 Compliance with Law. Customer and all Guests will comply with all applicable federal, state, and local laws, including laws on alcohol, controlled substances, open containers, weapons, noise, and public conduct, both in the Vehicle and at every stop.
Article 4 — Reservations, Deposits, Rates, and Gratuity
4.1 Reservation Requests. A Reservation is a request only and does not reserve a Vehicle or date. When submitting a Reservation, Customer provides a payment card, which Company stores through its payment processor but does not charge while Company reviews availability.
4.2 Deposit and Confirmation. If Company accepts the Reservation, Company will charge a non-refundable Deposit of $325 to Customer's card and send a Confirmation. A Charter is confirmed only when the Deposit has been charged and the Confirmation sent. If Company does not accept the Reservation, Customer's card will not be charged. The Deposit is applied to the Charter Price and is refundable only as stated in Section 9.4.
4.3 Customer Review. Customer will review the Confirmation promptly and notify Company in writing of any error. The Confirmation is deemed accurate unless Customer notifies Company before the Charter.
4.4 Rates. The Charter Price is based on the Published Rates for the Vehicle, date, day, time, duration, season, and package selected. Company may change its Published Rates at any time, but changes do not affect a confirmed Charter except for services added after confirmation. Added time, added services, changes requested by Customer, and the fees and charges in this Agreement are in addition to the Charter Price. Company's rates and charges are subject to any rate schedule on file with a regulatory authority, which controls in case of conflict.
4.5 Gratuity. The Charter Price includes a standard gratuity for the driver. Any additional gratuity is voluntary.
Article 5 — Payment Terms
5.1 Balance Due. The balance of the Charter Price is due at or before the scheduled pickup time. Customer may pay the balance in advance or pay the driver at pickup. If the balance is unpaid when the Charter begins, Company may charge it to Customer's card on file. Company may decline to begin the Charter until the balance is paid or authorized.
5.2 Accepted Payment Methods. Company accepts cash, credit cards, debit cards, and Venmo. Checks are accepted only for weddings and for business accounts approved in writing by Company. Company may refuse any payment method.
5.3 Payment Fees.
No fee applies to the Deposit or to amounts paid in cash.
Amounts paid by credit card are subject to a surcharge of 3%, which will not exceed Company's cost of accepting the card. The surcharge will be disclosed before payment and shown separately on the receipt. No surcharge applies to debit or prepaid cards, even if processed as credit.
Amounts paid by Venmo are subject to a payment fee of 3%.
5.4 Additional Charges. Tolls, parking, venue or access fees, permits, and similar costs incurred at Customer's request or because of Customer's itinerary are added to the amount due. Charges for added miles or hours requested by Customer are due immediately.
5.5 Returned Payments. For any check or electronic payment that is returned or dishonored, Customer will pay the amount due plus a returned-payment fee in the maximum amount permitted by law, and Company may require payment by cash or card for the balance and any future Charter.
5.6 Late Payment. Amounts not paid when due bear interest from the due date at the lesser of 1.5% per month or the maximum rate permitted by law, and are subject to Article 31.
5.7 No Setoff. Customer may not withhold or offset any amount owed because of a claim against Company. Customer's remedies are limited to those stated in this Agreement.
Article 6 — Card on File and Payment Authorization
6.1 Authorization. Customer authorizes Company to store Customer's payment card through Company's payment processor and booking software as a stored credential, and to charge that card, or any replacement card Customer provides, without further signature or approval, for:
the Deposit when Company accepts the Reservation;
the balance of the Charter Price at or after pickup, if not already paid;
Additional Time and added services;
cancellation charges under Article 7;
cleaning, bio-hazard, damage, theft, and fine charges under Article 17;
tolls, parking, and other charges under Section 5.4;
surcharges and payment fees under Section 5.3; and
any other amount Customer owes under this Agreement.
6.2 Post-Charter Charges. Before charging Customer's card for any amount assessed after the Charter ends, such as damage or bio-hazard charges, Company will send Customer an itemized statement, with photographs or other documentation where applicable, by email or text to the contact information in the Reservation. Company may charge the card after sending that statement.
6.3 Card Holder. If the card belongs to someone other than Customer, Customer represents that the card holder has authorized these charges, and Customer and the card holder are jointly and severally liable for them.
6.4 Duration; Replacement Cards. This authorization continues until all amounts owed under this Agreement are paid in full. If a card is declined, expired, or cancelled, Customer will provide a valid replacement within 7 days, and Company may use updated card information supplied by the card network or processor.
6.5 Disputes and Chargebacks. Customer agrees to contact Company at info@rnrbus.com about any charge before disputing it with a card issuer or payment service. Customer acknowledges that all charges authorized by this Agreement are valid. If Customer disputes a valid charge, Customer will reimburse Company's chargeback fees and collection costs, and Company may provide this Agreement, the Reservation, the Confirmation, Recordings, photographs, driver reports, and Customer's communications to the card issuer or payment processor to respond to the dispute.
Article 7 — Cancellations and Changes by Customer
7.1 Written Notice. Customer may cancel only by written notice emailed to info@rnrbus.com. Cancellation is effective when Company receives it. Company will confirm receipt; if Customer does not receive confirmation within 24 hours, Customer must call 712-314-3034. Failing to appear, or telling a driver, does not cancel a Charter.
7.2 Cancellation Charges. Measured from the scheduled pickup date:
Any cancellation: the Deposit is forfeited.
Less than 30 days before: 50% of the Charter Price, with the Deposit credited toward that amount.
Less than 14 days before: 100% of the Charter Price.
Company may charge any amount due to Customer's card on file.
7.3 Liquidated Damages. The parties agree that Company's damages from a cancellation, including lost bookings turned away, scheduling and staffing commitments, and marketing costs, are difficult to determine at the time of contracting, and that the charges in Section 7.2 are a reasonable estimate of those damages and not a penalty.
7.4 Weather and Customer's Choice. If Company is able and willing to perform the Charter, a cancellation by Customer because of weather, road conditions, illness, venue changes, or any other reason is subject to Section 7.2.
7.5 Date, Time, and Length. Customer is bound to the date and duration reserved. Time added to a Charter cannot later be removed or refunded.
7.6 Changes. A request to change Vehicles requires at least 30 days' written notice and is subject to availability and any price difference. Any other change is subject to Company's approval and availability, and Company may charge for any resulting price difference. A reduction in the number of Guests does not reduce the Charter Price.
7.7 Transfer. Customer may not transfer a Reservation to another person or date without Company's written consent.
Article 8 — Charter Time, Additional Time, and Driver Hours
8.1 Charter Time. Charter time begins at the scheduled pickup time, whether or not Customer's group is present or ready, and ends at the scheduled end time. Waiting time is Charter time. Company does not refund or extend for late arrival of Guests, unused time, early termination by Customer, or failure to appear.
8.2 Additional Time. Additional Time may be requested before or during the Charter. It requires approval by Company management and the availability of the Vehicle and a qualified driver, and it is never guaranteed on the day of the Charter. Approved Additional Time is billed at the additional-time rate in the Published Rates, is due when added, and may be paid that night or charged to the card on file.
8.3 Overtime Without Approval. If a Charter runs past its scheduled end time because of Guests' conduct or delay, Customer will pay for the excess time at the additional-time rate, and the driver may end the Charter as soon as it is safe to do so.
8.4 Driver Hours. Company's drivers are subject to legal limits on driving and on-duty time. A Charter may be shortened, or may require a relief driver at additional cost, if needed to comply with those limits. A shortening required for compliance with a limit disclosed before the Charter is not a breach.
Article 9 — Substitutions, Delays, and Cancellations by Company; Force Majeure
9.1 Vehicle Substitution. Company will make reasonable efforts to provide the Vehicle reserved. Because of mechanical problems, prior Charters running late, accidents, or other circumstances, Company may substitute another Vehicle from its fleet, from an affiliate, or from another properly licensed and insured carrier. A substitution does not by itself entitle Customer to a reduction in price. If the substitute has a lower Published Rate than the Vehicle reserved, Company will refund the difference.
9.2 Unsafe Conditions. The driver and Company may delay, reroute, pause, shorten, or end a Charter at any time if, in their judgment, weather, road, traffic, mechanical, or other conditions make travel unsafe. Such decisions are made for the safety of Guests and the public and are not a breach.
9.3 Force Majeure. Company is not responsible for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, severe weather, flood, fire, accidents, road closures, traffic, mechanical failure despite reasonable maintenance, strikes, labor shortages, riots, terrorism, epidemics or public health orders, governmental action, utility or communications failures, or acts or omissions of Guests or third parties.
9.4 Case-by-Case Remedies. If a mechanical failure, unsafe condition, or event under Section 9.3 prevents, delays, interrupts, or shortens a Charter, Company will work with Customer in good faith and will determine, on a case-by-case basis and in its reasonable discretion, whether to provide a substitute Vehicle, reschedule, issue a credit toward a future Charter, or refund part or all of the amounts paid for the affected service. If Company cancels a Charter before it begins and cannot provide a substitute Vehicle or an alternate date acceptable to Customer, Company will refund the amounts Customer paid for that Charter.
9.5 Exclusive Remedy. Section 9.4 states Customer's sole and exclusive remedy for any substitution, delay, interruption, shortening, or cancellation by Company, and Company's total liability for any such event will not exceed the amounts Customer paid for the affected Charter. Company is not liable for missed events, tickets, reservations, travel, or other consequential losses.
Article 10 — Eligibility to Ride and Identification
10.1 Age. No Underage Guest may board or ride except as permitted by Article 11.
10.2 Identification. Every Guest must carry an original, valid, unexpired government-issued photo identification and show it to the driver on request at any time. Acceptable forms are a driver's license or state identification card, a military identification card, a passport or passport card, and a permanent resident card. A temporary paper license is acceptable only together with the Guest's prior physical state-issued card. Photocopies, photographs, printed images, and screenshots of identification are not accepted.
10.3 Refusal. A Guest who cannot produce acceptable identification on request may be refused boarding or removed at the next safe stop. Refusal of any Guest does not reduce the Charter Price.
10.4 How Identification Is Checked. Drivers check identification visually. Company does not copy, photograph, scan, or retain identification documents or the information on them.
10.5 False Identification. Presenting false, altered, borrowed, or invalid identification is a material breach of this Agreement. Company may end the Charter under Article 14 and may report the conduct to law enforcement.
Article 11 — Underage Guests and Chaperones
11.1 When Underage Guests Are Permitted. Underage Guests are permitted without further approval on holiday light tours and daytime weddings. For any other Charter, Underage Guests are permitted only if Company approves them before the Reservation is submitted. Approval may be given by email or text or noted in the Confirmation, and Company may decline any request in its sole discretion.
11.2 Customer's Representations About Minors. By accepting this Agreement, Customer represents, warrants, and agrees that, before the Charter, Customer will: (a) inform the Parent of every Minor of the Charter's date, times, itinerary, and stops, the presence of any adults and any alcohol, the Rider Rules, and the risks described in Article 23; (b) provide each Parent with a copy of or link to this Agreement; (c) obtain each Parent's permission for the Minor to ride subject to this Agreement; and (d) inform every Underage Guest of the Rider Rules. Company may rely on these representations without verifying them, and any failure to meet them is a material breach by Customer.
11.3 Customer's Responsibility and Indemnity for Minors. Customer accepts full responsibility for all Underage Guests and for their supervision and conduct throughout the Charter, including while boarding, at stops, and while exiting. To the fullest extent permitted by law, Customer will defend, indemnify, and hold harmless the Company Parties from and against all Claims brought by or on behalf of any Underage Guest or any Parent arising out of or related to the Charter, including Claims alleging the ordinary negligence of a Company Party, but excluding Claims caused by a Company Party's gross negligence or intentional misconduct. This Section is in addition to Customer's obligations under Articles 17 and 25.
11.4 Chaperones. Whenever a Minor is aboard, at least one Chaperone who is a Parent of a Minor aboard must ride for the entire Charter, and Customer must provide enough Chaperones to supervise every Minor. Company may require additional Chaperones based on the number or ages of Minors. Each Chaperone must: (a) supervise the Minors at all times, including while boarding, riding, at stops, and exiting; (b) remain capable of supervising and not be impaired by alcohol or drugs; (c) enforce the Rider Rules and keep alcohol away from Underage Guests; (d) keep Minors with the group at every stop; (e) remain with the Minors if the Charter ends early; and (f) ensure each Minor is released only to his or her Parent or an adult the Parent has authorized. If these requirements are not met, Company may refuse to transport the Minors or may end the Charter under Article 14, without refund.
11.5 Emergency Care for Minors. Customer represents that each Minor's Parent has authorized the Chaperones to consent to emergency medical care for the Minor if the Parent cannot be reached. The driver may call 911 for any Minor at any time. Company has no duty to provide or consent to medical care, and the cost of any emergency care or transport is the responsibility of the Minor's Parent or Customer.
11.6 Boarding, Exiting, and Release of Minors. Minors must board at the scheduled pickup location and may exit only with a Chaperone, at a scheduled stop, at the final destination, or as provided in Section 14.3. Company does not release Minors to any person and is not responsible for where or with whom a Minor goes after exiting the Vehicle; Customer and the Chaperones are solely responsible for that.
11.7 Child Safety Seats. Company does not provide child safety seats or booster seats. Customer and each child's Parent are responsible for deciding whether a child needs one and for providing it.
11.8 Laws Applicable to Minors. Customer and the Chaperones are responsible for compliance with all laws that apply to Minors during the Charter, including curfew ordinances and laws on alcohol, tobacco, and vaping products.
11.9 Alcohol and Underage Guests. No Underage Guest may possess, consume, or be given alcohol at any time. Guests 21 and older may bring alcohol only as permitted by Article 12, and Customer and each Chaperone are responsible for keeping it away from Underage Guests. Providing alcohol to a person under 21 is a crime under Nebraska and Iowa law.
11.10 Violations. If an Underage Guest boards without permission under Section 11.1, possesses or consumes alcohol or any controlled substance, or presents false identification, the Charter will end, no refund will be given, and the full Charter Price and all charges remain due. The driver will follow the safe-return procedure in Section 14.3, and Company may notify Parents and law enforcement.
11.11 No Custody or Supervision by Company. Company and its drivers do not supervise, chaperone, babysit, or take custody of any Underage Guest and have no duty to monitor them. A driver's role is limited to operating the Vehicle and enforcing the Rider Rules.
Article 12 — Alcohol
12.1 No Sale or Service. Company and its employees do not sell, serve, pour, mix, or furnish alcohol. Guests 21 and older may bring their own alcohol for their own consumption where permitted by law and this Agreement. Guests are solely responsible for what and how much they drink.
12.2 Prohibited Items. The following are not permitted aboard any Vehicle: glass beer bottles, jello or gelatin shots, red wine, kegs, beer bongs and funnels, and any container of 5 gallons or more. Company may prohibit any other container or item it considers unsafe.
12.3 Inspection. By bringing any cooler, bag, or container aboard, the Guest consents to its inspection by the driver. The driver may refuse, remove, or dispose of any prohibited item or any alcohol in the possession of an Underage Guest.
12.4 Refusal of Intoxicated Persons. Company may refuse to transport any person who appears intoxicated or impaired, or who is, or is likely to become, a danger or objectionable to others.
12.5 Open Containers Off the Vehicle. Guests may not carry open containers of alcohol off the Vehicle, and Customer is responsible for any citation or fine resulting from Guests' alcohol-related conduct.
12.6 License and Inspections. Company holds a license from the Nebraska Liquor Control Commission. State and local liquor officials may inspect a Vehicle while it is stopped for passengers to board or exit, and Company will cooperate with them.
12.7 No Responsibility for Consumption. Company is not responsible for alcohol consumed by any Guest before, during, or after the Charter, or for the consequences of that consumption. Customer assumes all responsibility for ensuring that no Guest drives after drinking.
Article 13 — Rider Rules
13.1 Conduct Required of All Guests. Every Guest must:
follow all instructions of the driver and Company at all times;
remain seated, or hold a handrail or other fixture designed for holding, whenever the Vehicle is moving, and use seat belts where provided when seated;
keep all body parts and objects inside the Vehicle, and never hang out of, sit in, or stand through any window, door, or roof hatch;
not stand on seats, sit on seat backs, ledges, or tables, or climb on any fixture;
stay out of the driver's area and never touch or interfere with the driver, controls, doors, emergency exits, or safety equipment except in a genuine emergency;
keep aisles, steps, and exits clear;
not throw anything inside the Vehicle or out of it;
treat the driver and other Guests with respect, with no threats, violence, harassment, or indecent conduct; and
comply with all laws at every stop.
13.2 Prohibited on Any Vehicle.
Smoking or vaping of any kind, including cigarettes, cigars, pipes, electronic cigarettes and vapes, and cannabis in any form.
Illegal drugs and controlled substances not lawfully prescribed to the Guest.
Weapons of any kind, including firearms, knives, and look-alike weapons, and explosives, fireworks, flares, and incendiary devices. Company will not transport any person in possession of them.
Confetti, glitter, silly string, popcorn, candles, open flames, and items that stain or damage surfaces.
Animals, other than service animals under Article 19 or pets approved in advance.
Any item prohibited by Section 12.2.
13.3 Capacity. The number of Guests may never exceed the Vehicle's rated seating capacity. The driver will refuse boarding to anyone over capacity, and the Charter Price will not be reduced.
13.4 Fixtures and Effects. Handrails, poles, lighting, sound systems, and other fixtures are provided for enjoyment and may be used only as intended. Lighting effects, including strobe and laser lights, and loud music may affect people with photosensitive conditions, hearing sensitivity, or other conditions, and Guests should ask the driver to turn them off if needed.
13.5 Guests Unable to Ride Safely. A Guest who cannot remain awake, stand or walk steadily, or follow instructions may not board or continue riding.
Article 14 — Driver Authority and Termination of Service
14.1 Safety First. The driver's primary responsibilities are the safety of all passengers and the public and the protection of the Vehicle. The driver may refuse boarding to any person and may give any instruction reasonably related to safety.
14.2 Termination for Cause. The driver or Company may end a Charter immediately if, in their judgment, any Guest's conduct is unsafe, illegal, out of control, threatening, abusive, or disrespectful; any Guest violates this Agreement or the Rider Rules; any Underage Guest violates Article 11; or continuing would place any person or property at risk.
14.3 Safe-Return Procedure. When a Charter is ended under Section 14.2, the driver will return the group to the original pickup location. If continuing to drive would be unsafe, the driver will instead stop at the nearest safe, lighted public location. The driver may contact law enforcement or emergency services at any time. The driver will not leave any Minor without a Chaperone. Company's service ends when the group is returned or stopped under this Section, and each Guest is responsible for his or her own transportation afterward.
14.4 No Refund; Liability. When a Charter ends under Section 14.2, no refund will be given, the full Charter Price and all charges remain due, and Company is not liable for any consequence of the termination.
14.5 Removal of Individual Guests. Instead of ending the Charter, the driver may require a particular Guest to leave the Vehicle at the original pickup location or another safe, lighted public location, and Customer is responsible for that Guest's onward transportation.
Article 15 — Intoxication, Illness, and Emergencies
15.1 Intoxicated Guests. If a Guest becomes too intoxicated or impaired to ride safely, Customer must use Charter time to return that Guest to the original pickup location or arrange alternative transportation, such as a sober driver, taxi, or rideshare, from a safe location. Charter time is not extended for this purpose.
15.2 Emergency Services. If any Guest appears unconscious, unresponsive, injured, seriously ill, or in danger, the driver may stop the Vehicle and call 911 or other emergency services, and the Charter may end. Customer and Guests consent to the driver summoning emergency assistance and to disclosure of relevant information to responders.
15.3 No Medical Services. Company's drivers are not medical professionals and do not provide medical care, monitoring, or supervision of Guests. Company's only obligation in an emergency is to summon emergency services. Any cost of emergency services, transport, or treatment is the responsibility of the Guest receiving it.
15.4 Guest Health. Guests with medical conditions, pregnancy, mobility limitations, seizure disorders, or other health concerns ride at their own risk, should remain seated while the Vehicle is moving, and are responsible for bringing any medication they need.
Article 16 — Pickup, Drop-Off, Stops, Routes, and Delays
16.1 Locations. Because of the height, length, and weight of Company's Vehicles, not every location can be served. Customer is responsible for obtaining any permission required from property owners or venues for pickup, drop-off, and stops. The driver will stop as close to each location as the driver determines is safe and lawful, and Guests are responsible for their own safety while walking to and from the Vehicle.
16.2 Residential Addresses. Company does not pick up or drop off at most residential addresses. A residential location that is safe and easily accessible may be approved in writing before the Charter date.
16.3 Stops and Routes. Within the Omaha–Council Bluffs metropolitan area, there is no limit on the number of stops during the reserved time. The driver determines the route, may decline any stop or route the driver considers unsafe or unlawful, and may refuse to wait in any location where waiting is unsafe or prohibited.
16.4 End of Service. Company's service ends when the group is dropped at the final destination in the Confirmation, at another location agreed by the driver, or under Section 14.3. Company has no responsibility for any Guest after he or she exits the Vehicle, including the Guest's transportation home. Customer is solely responsible for ensuring that no Guest drives while impaired.
16.5 Arrival Times. Arrival times at pickup, stops, and destinations are estimates and are not guaranteed. The driver will obey all traffic laws. Delays caused by traffic, weather, road conditions, events, Guests, or other circumstances beyond Company's control are not grounds for cancellation, refund, or price reduction.
Article 17 — Cleaning, Bio-Hazard, Damage, Theft, and Fines
17.1 Bio-Hazard. Customer will pay $200 for each incident of vomit, urine, blood, or other bodily fluid in or on a Vehicle, without exception.
17.2 Excessive Mess. Customer will pay $75 if a Vehicle requires cleaning beyond normal use, including spills, food, confetti or glitter, or trash left behind.
17.3 Damage and Theft. Customer is liable for all damage to a Vehicle and its equipment caused by Customer or any Guest, beyond normal wear and tear, and for any item stolen from a Vehicle during the Charter. Customer will pay the cost of replacement parts and materials, labor at $150 per hour, towing or transport, and revenue lost while the Vehicle is out of service, including Charters Company must cancel or reassign.
17.4 Fines and Citations. Customer will reimburse Company for any fine, penalty, citation, or cost imposed on Company or its drivers because of the conduct of any Guest, including open-container, littering, noise, and underage-alcohol violations.
17.5 Documentation. Company will document charges under this Article with photographs, Recordings, repair estimates or invoices, or driver reports, and will provide Customer an itemized statement under Section 6.2. Company's documentation is presumed accurate unless Customer shows otherwise by clear evidence.
17.6 Joint Responsibility. Customer is responsible for all charges under this Article regardless of which Guest caused them. Company may also pursue the Guest who caused the loss.
Article 18 — Personal Property and Lost Items
18.1 Guests' Property. All personal property brought aboard is at the owner's sole risk. Company is not a bailee of any property and is not liable for property that is lost, stolen, left behind, damaged, or destroyed, whether in a Vehicle, at a stop, or while boarding or exiting.
18.2 Lost and Found. Company will hold found items it recovers for 30 days. The owner must arrange pickup or pay shipping in advance. Items unclaimed after 30 days may be discarded or donated. Perishable items, open alcohol, and unsanitary items may be discarded immediately. Company may turn over items that appear illegal to law enforcement.
Article 19 — Accessibility, Service Animals, and Pets
19.1 Accessibility. Company complies with applicable disability laws. Customer should tell Company when making the Reservation about any Guest who needs an accommodation, so Company can arrange appropriate service. Vehicles have steps and interiors that vary by Vehicle.
19.2 Service Animals. Service animals are permitted as required by law. The handler is responsible for the animal's control and for any damage or cleaning it causes.
19.3 Pets. Pets and other animals that are not service animals are not permitted without Company's prior written approval.
Article 20 — Recording, Photography, and Media Release
20.1 Onboard Recording. Company's Vehicles are equipped with cameras that record video and, where equipped, audio inside and around the Vehicle. Notices are posted in the Vehicles. No recording occurs inside any restroom compartment. By making a Reservation or boarding a Vehicle, Customer and each Guest consent to being recorded. Guests have no expectation of privacy in a Vehicle except inside a restroom compartment.
20.2 Purposes. Company may use Recordings for safety, security, driver supervision and training, investigating incidents and complaints, documenting damage and charges, responding to payment disputes, defending or pursuing claims, complying with law and legal process, and marketing as permitted by Section 20.4.
20.3 Ownership and Disclosure. All Recordings are Company's sole property. Company has no obligation to retain any Recording and may overwrite Recordings in the ordinary course unless Company preserves them for an incident or claim. Company may disclose Recordings to its insurers, attorneys, payment processors, regulators, and law enforcement, and as required by law. Customer and Guests have no right to obtain Recordings except as required by law or court order.
20.4 Media Release. Customer, for Customer and on behalf of each Guest to the extent Customer is authorized to do so, grants Company and its licensees a perpetual, worldwide, royalty-free, irrevocable license to record, use, edit, publish, and display photographs, video, audio, and still images taken during the Charter, including images captured by onboard cameras and images depicting Guests, in Company's website, social media, advertising, and other marketing, without compensation, inspection, or approval. Company will not identify any Guest by name without permission and will not use in marketing any image of a Guest under 19 years of age.
20.5 Opting Out. Any Guest may opt out of marketing use by telling the driver during the Charter or by emailing info@rnrbus.com with a description or copy of the image. Company will stop using identifiable images of that Guest in new marketing and will remove them from posts Company controls within a reasonable time. Opting out does not affect Recordings used for the other purposes in Section 20.2.
20.6 Waiver of Publicity and Privacy Claims. To the fullest extent permitted by law, Customer releases the Company Parties from, and will indemnify them against, all Claims by Customer or any Guest arising from recording, or from use of Guests' images or likenesses consistent with this Article, including claims for invasion of privacy, misappropriation, right of publicity, and defamation. Customer will inform all Guests of this Article before the Charter.
20.7 Guests' Own Recording. Guests may take their own photographs and videos, but may not record the driver in a way that interferes with safe operation, and are responsible for any use they make of them.
Article 21 — Communications: Calls, Texts, and Email
21.1 Consent to Contact. Customer consents to receive calls, emails, and text messages from Company at the contact information provided, about the Reservation, the Charter, payment, charges, surveys, and customer service. Customer represents that Customer is the subscriber or authorized user of the phone number provided.
21.2 Text Message Program. Company's reservation text program sends confirmations, reminders, driver and pickup updates, and replies to Customer's messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help, or contact info@rnrbus.com or 712-314-3034. Wireless carriers are not liable for delayed or undelivered messages. Company will send marketing text messages only to people who separately opt in to them, and consent to marketing is not a condition of any purchase.
21.3 No Sharing of Mobile Information. Company does not share or sell mobile phone numbers, text message opt-in data, or consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with the service providers that deliver Company's messages.
21.4 Call Recording. Calls to and from Company may be monitored and recorded for quality, training, record-keeping, and dispute resolution. By calling or remaining on a call with Company, Customer consents to recording.
Article 22 — Privacy
Company's collection, use, and disclosure of personal information, including Recordings, call recordings, payment information, and information about Underage Guests, is described in Company's Privacy Policy, which is incorporated into this Agreement.
Article 23 — Assumption of Risk
23.1 Inherent Risks. Customer acknowledges that riding in and celebrating aboard a party bus or limousine is a voluntary, recreational, non-essential activity that involves risks that cannot be eliminated, including:
sudden braking, acceleration, turns, bumps, and swerving, and collisions caused by other drivers or road conditions;
standing, dancing, moving about, or using poles, handrails, or fixtures while the Vehicle is moving;
slips, trips, and falls on steps, aisles, wet or crowded floors, curbs, parking lots, and streets while boarding, riding, or exiting;
dim, flashing, strobe, or laser lighting, smoke or haze effects, and loud music;
the consumption of alcohol by Customer or others, and the conduct of intoxicated persons;
the acts or omissions of other Guests, including horseplay, fights, assaults, theft, and unwanted contact;
conditions, crowds, and persons at stops, venues, and destinations Company does not control;
weather, temperature, mechanical failure, delays, and road hazards;
exposure to communicable illnesses, allergens, and food or beverages brought by others; and
the risks of any pre-existing medical condition, pregnancy, or physical limitation.
23.2 Assumption. These risks can result in property damage, serious bodily injury, emotional distress, or death. CUSTOMER KNOWINGLY AND VOLUNTARILY ASSUMES ALL OF THESE RISKS, KNOWN AND UNKNOWN, FOR CUSTOMER, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE COMPANY PARTIES, and will inform every Guest of these risks before the Charter.
23.3 Freedom of Choice. Customer acknowledges that the Charter is not an essential service, that Customer is free to choose another transportation provider or to decline this Agreement, and that Customer had the opportunity to read this Agreement and ask questions before accepting it.
Article 24 — Release of Liability and Covenant Not to Sue
PLEASE READ CAREFULLY. BY ACCEPTING THIS AGREEMENT, CUSTOMER GIVES UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.
24.1 Release. IN CONSIDERATION OF BEING PERMITTED TO RESERVE AND PARTICIPATE IN THE CHARTER, CUSTOMER, FOR CUSTOMER AND CUSTOMER'S HEIRS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, AND ASSIGNS, TO THE FULLEST EXTENT PERMITTED BY LAW, RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE THE COMPANY PARTIES FROM AND FOR ANY AND ALL CLAIMS FOR BODILY INJURY, ILLNESS, EMOTIONAL DISTRESS, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING OUT OF OR RELATED TO THE CHARTER, THE VEHICLE, OR THIS AGREEMENT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY COMPANY PARTY.
24.2 Third-Party Acts. Without limiting Section 24.1, Customer releases the Company Parties from all Claims arising from the acts or omissions of any Guest or other third party, from alcohol consumed by any person, and from conditions at any stop or destination.
24.3 Exclusions. This Article does not release Claims arising from a Company Party's gross negligence, recklessness, or intentional misconduct, or any Claim that cannot be released under applicable law.
24.4 No Personal Liability of Individuals. Customer agrees that no member, manager, owner, officer, employee, driver, or agent of Company will be personally liable to Customer for any Claim arising from the Charter or this Agreement, except for that individual's own intentional misconduct. Customer will look solely to Company for any Claim that is not released.
24.5 Intent and Scope. Customer intends this release to be as broad and inclusive as permitted by law. If any part of this Article is held invalid, the remainder continues in full force.
24.6 Customer's Own Minor Children. If any Minor on the Charter is Customer's child or ward, Customer, as that Minor's parent or legal guardian, also gives the assumption of risk in Article 23 and the release and covenant in this Article on behalf of that Minor, to the fullest extent permitted by law.
Article 25 — Indemnification
25.1 Indemnity. To the fullest extent permitted by law, Customer will defend, indemnify, and hold harmless the Company Parties from and against all Claims, including Claims by Guests, by or on behalf of Underage Guests, and by other third parties, and including Claims alleging that the ordinary negligence of a Company Party contributed to the loss, arising out of or related to:
any act or omission of Customer or any Guest, whether negligent, reckless, or intentional;
any breach of this Agreement or the Rider Rules by Customer or any Guest;
the possession, consumption, provision, or furnishing of alcohol or controlled substances by or to any Guest, including any person under 21;
any injury to any Guest caused by another Guest;
damage to any Vehicle or other property caused by Customer or any Guest; and
any fine, citation, or penalty resulting from the conduct of Customer or any Guest.
25.2 Exclusion. Section 25.1 does not require Customer to indemnify a Company Party against a Claim to the extent it was caused by that Company Party's gross negligence or intentional misconduct.
25.3 Defense. Company may select counsel to defend any Claim subject to this Article, at Customer's expense, or may require Customer to assume the defense with counsel reasonably acceptable to Company. Customer may not settle any Claim in a manner that imposes any obligation or admission on a Company Party without Company's written consent.
25.4 Survival. This Article survives the end of the Charter and any termination of this Agreement.
Article 26 — Disclaimer of Warranties; Amenities
26.1 Disclaimer. Except as expressly stated in this Agreement, Company provides the Charter and all Vehicles, equipment, and amenities "as is," and to the fullest extent permitted by law disclaims all warranties and representations, express or implied, including warranties of fitness for a particular purpose and any representation made in advertising, photographs, or website content. Nothing in this Article limits any duty that cannot be disclaimed under applicable law.
26.2 Amenities. Sound systems, Bluetooth connections, lighting, televisions, climate control, restrooms, coolers, and other amenities vary by Vehicle, are provided as a courtesy, and are not guaranteed. The malfunction or unavailability of any amenity does not entitle Customer to a refund, credit, or price reduction. Photographs and descriptions of Vehicles are illustrative.
Article 27 — Limitation of Liability
27.1 Exclusion of Certain Damages. TO THE FULLEST EXTENT PERMITTED BY LAW, NO COMPANY PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST EVENTS, TICKETS, RESERVATIONS, TRAVEL, WAGES, PROFITS, OR ENJOYMENT, ARISING OUT OF OR RELATED TO THE CHARTER OR THIS AGREEMENT, EVEN IF ADVISED OF THEIR POSSIBILITY.
27.2 Cap. EXCEPT FOR CLAIMS FOR BODILY INJURY OR DEATH AND CLAIMS ARISING FROM A COMPANY PARTY'S GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, THE TOTAL LIABILITY OF ALL COMPANY PARTIES COMBINED FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE CHARTER OR THIS AGREEMENT WILL NOT EXCEED THE AMOUNTS CUSTOMER ACTUALLY PAID TO COMPANY FOR THE CHARTER.
27.3 Basis of the Bargain. Customer agrees that the limitations in this Agreement are an essential part of the bargain, that Company's prices reflect them, and that they apply regardless of the legal theory on which a Claim is based and even if a limited remedy fails of its essential purpose.
Article 28 — Notice of Claims and Time Limits
28.1 Billing Disputes. Customer must notify Company in writing at info@rnrbus.com of any dispute about a charge within 30 days after the charge. Charges not disputed within that time are final, to the fullest extent permitted by law.
28.2 Property Claims. Any claim for loss of or damage to personal property must be reported to Company in writing within 7 days after the Charter.
28.3 Incidents. Customer must report any incident, injury, or complaint to Company in writing as soon as reasonably possible, and in any event within 30 days after the Charter, so Company can investigate and preserve Recordings.
28.4 Time to Bring Claims. To the fullest extent permitted by law, any Claim by Customer arising out of or related to this Agreement or the Charter, other than a Claim for bodily injury or death, must be brought within one year after it arises, or it is permanently barred.
Article 29 — Dispute Resolution; Arbitration; Class Action and Jury Waivers
PLEASE READ THIS ARTICLE CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS.
29.1 Informal Resolution First. Before starting arbitration or any legal proceeding, a party must send the other a written notice describing the claim and the relief sought: to Company at info@rnrbus.com and at its mailing address, and to Customer at the email in the Reservation. The parties will try in good faith to resolve the claim for 30 days after the notice is received.
29.2 Agreement to Arbitrate. Except as provided in Section 29.4, any dispute, claim, or controversy between Customer and any Company Party arising out of or relating to this Agreement, the Charter, any Vehicle, any Recording, or any communication with Company, including bodily injury claims and disputes about the scope or enforceability of this Article, will be resolved by final and binding arbitration on an individual basis. The Company Parties are intended beneficiaries of this Article and may enforce it.
29.3 Procedure. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if Customer is a business, before a single arbitrator. The hearing will take place in Pottawattamie County, Iowa, or by video, telephone, or written submissions as the arbitrator allows. Company will pay the filing, administrative, and arbitrator fees that the applicable rules require a business to pay. The arbitrator may award any individual relief that a court could award under this Agreement, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this Article.
29.4 Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek temporary injunctive relief in court to prevent irreparable harm pending arbitration.
29.5 Class Action Waiver. CUSTOMER AND COMPANY MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of different persons.
29.6 Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOMER AND COMPANY EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE CHARTER, INCLUDING ANY CLAIM THAT PROCEEDS IN COURT.
29.7 Right to Opt Out. Customer may opt out of Sections 29.2 through 29.5 by emailing info@rnrbus.com within 30 days after first accepting this Agreement, stating Customer's name, Reservation date, and that Customer opts out of arbitration. Opting out does not affect any other provision, including Section 29.6 and Article 30.
29.8 Severability of this Article. If the class action waiver in Section 29.5 is found unenforceable as to any claim, that claim will proceed in court under Article 30 and not in arbitration. If any other part of this Article is found unenforceable, the remainder continues in effect.
Article 30 — Governing Law and Venue
30.1 Governing Law. This Agreement is governed by the laws of the State of Iowa, without regard to its conflict-of-laws rules, except that Article 29 is governed by the Federal Arbitration Act. Section 24.6 is governed by the laws of the State of Nebraska.
30.2 Venue. Any claim that is not subject to arbitration, and any action to enforce an arbitration award, must be brought exclusively in the state or federal courts located in Pottawattamie County, Iowa. Each party consents to the personal jurisdiction of those courts and waives any objection based on inconvenient forum or improper venue.
Article 31 — Collections, Attorneys' Fees, and Default
31.1 Collection Costs. If Customer fails to pay any amount when due, Customer will pay all costs of collection, including reasonable attorneys' fees, court and arbitration costs, and collection agency fees, to the fullest extent permitted by law. Company may report unpaid amounts to collection agencies.
31.2 Default. If Customer fails to perform any obligation, including payment, or becomes insolvent or the subject of bankruptcy or receivership proceedings, Company may immediately suspend or terminate the Charter and any other Reservation, without liability and without waiving any other right or remedy.
31.3 Remedies Cumulative. Company's rights and remedies under this Agreement are cumulative and in addition to all rights and remedies available at law or in equity.
Article 32 — General Provisions
32.1 Entire Agreement. This Agreement, with the documents incorporated under Section 2.4, is the entire agreement between Customer and Company about the Charter and supersedes all prior statements, quotes, advertisements, and understandings. Any additional or different terms proposed by Customer are rejected.
32.2 Changes to These Terms. Company may update this Agreement by posting a new version with a new effective date. The version in effect when Customer's Reservation is accepted applies to that Charter, unless Customer agrees to a later version or a change is required by law.
32.3 Severability. If any provision of this Agreement is held invalid or unenforceable, it will be enforced to the maximum extent permitted and reformed as needed to reflect the parties' intent, and the remaining provisions continue in full force.
32.4 No Waiver. Company's failure or delay in enforcing any provision is not a waiver of it or of any later breach.
32.5 Assignment. Customer may not assign or transfer this Agreement without Company's written consent. Company may assign this Agreement, including to an affiliate or to a successor in connection with a sale, merger, or transfer of all or part of its business, and this Agreement binds and benefits the parties' successors and permitted assigns.
32.6 Third-Party Beneficiaries. The Company Parties are intended third-party beneficiaries of Articles 23 through 29 and may enforce them directly. No Guest or other person is a third-party beneficiary of any right or obligation of Company under this Agreement.
32.7 Relationship. Company is an independent contractor. Nothing in this Agreement creates a partnership, joint venture, agency, fiduciary, or custodial relationship between Company and Customer or any Guest.
32.8 Notices. Company may give notices, statements, and confirmations to Customer by email or text message to the contact information in the Reservation, and they are effective when sent. Customer must give notices to Company by email to info@rnrbus.com, with a copy by mail to Rockin N Rollin LLC, [mailing address], for any notice under Article 29, and they are effective when received.
32.9 Electronic Records. Customer consents to receive this Agreement and all related records electronically. An electronic or photocopied record of this Agreement and of Customer's acceptance is as valid as an original.
32.10 Survival. Articles 5, 6, 11, 17, 18, and 20 through 32, and Section 12.7, survive completion, cancellation, or termination of the Charter.
32.11 Reviews. Nothing in this Agreement restricts Customer's right to post honest reviews of Company.
Article 33 — Customer Acknowledgment
BY CHECKING THE ACCEPTANCE BOX, SUBMITTING A RESERVATION, PAYING A DEPOSIT, SIGNING, OR BOARDING, CUSTOMER ACKNOWLEDGES AND AGREES THAT:
